Disambiguation is based on the subsequent form, regardless of whether that form of the cite appears in the document or no. So it would kick in in both of those cases.

This should be fixed now in the latest processor version (citeproc-js v1.1.185). You can test it by installing the Propachi plugin. Remove the plugin after the next Zotero update, since it will likely pull in the new processor version.

I'm pretty sure that fix is in for this bug. If it hasn't healed in the latest Zotero beta, it will be fixed in the next.

As @adamsmith says. If the exact input shown in the pandoc test were fed to citeproc-js with the (pre-revision) style, it should produce the same result (i.e. with the comma before the closing quote).
