[Juris-M] for Frank - Has there been any thought put into how to cite unreported / e-archive cases?

I'm particularly trying to insert WestLaw or LEXIS information into a citation, but when you use a regular Case citation, that info gets skipped b/c it's not normally needed.

Is it possible to create another reference type for unreported cases and or electronic archives, or to come up with some way to cite in this format:

<CASE_NAME>, No. <DOCKET#>, <ARCHIVE_YEAR> <ARCHIVE_NAME> <ARCHIVE_LOCATION>, at *<PINCITE> (<JURISDICTION> <FULL_DATE_of_DECISION>).

It would be ideal if we could use the fields already in existence in the case reference type, such as issue (for the year of the archive), archive, and loc. in archive. And set it so that if there is the reporte field is blank, then the docket # and the archive information are used instead.

This comes up pretty often when writing about current issues, so it would be very helpful. I'm sure that's just what you wanted, was something else to code ;)

Can do. Most of that is already in place—which style are you using?

The JM Chicago Full Note and JM Bluebook styles use modular legal style support. See the US cheat-sheet to see what's there so far.

Unreported cases are covered, and follow that form. The archive info is not showing up yet, but it will be easy to stir that in. For the ARCHIVE_YEAR, we can use Year as Volume, so no additional fields needed.
  • And just in case it comes up, I'm not likely to build a site translator for WestLaw or Lexis unless they make it clear that it's not caught by their terms of use. I checked with Lexis staff about that a couple of years ago, and the answer was not encouraging. I haven't checked with WestLaw, but given their track record, it's not really necessary.

FastCase and CourtListener have been very welcoming, so if you want full translator support, those would be the services to use.
  • That guide will be very helpful thanks. Now that the abbreviation filter is working I've been using JM Babyblue since that seems to be the most current bluebook style. I've used MLZ also.

It looks like the framework is already there - all that would need to be added are the existing fields to cover the WestLaw cite and to expand the date to include the month and day.

Year as volume is fine, or I could just use put both parts of the archive (year and database) into the archive field to simply things, unless that would somehow prevent searching for all westlaw or lexis instances in a library which might be a useful function.

I can't imagine either westlaw or lexis would be happy with free utilities that interface with their websites in any way they could possibly make money from... with the rates they charge for simple searches I'm not surprised they don't play well with others.

I'm going to start looking more into FastCase and Courtlistener as I get closer to graduation. If I go into practice for myself westlaw and lexis are going to quickly become fond law school memories. Right now I can't imaging doing any legal research without one or the other so I need to ween myself off of them asap lol.
  • Oh, one other thing glitch I noticed in the windows version.

When you go to the addons page, and click on the options for the bluebook signals plugin, it apparently creates some popup window that is invisible, and once it's open you can't click anywhere else in the program so you have to close down the program and restart it. Alt+F4 doesn't close the invisible window either so it's not popping up in front of the addon window and alt-tab doesn't show anything that looks related.
  • Oh, thanks for that note. I'll look at it on Monday, before the releases.
  • I've tweaked the US domain to cover electronic service cites. See anything that should be changed in this sample?
    Case Name, No. 222, 2000 Lexis 333 (9th Cir. Feb. 5, 1953)
Things especially to check are the use of the "No." label on the docket number, and whether there should be a comma after "9th Cir."
  • That's correct.. the "No." is included and there is no comma after 9th Cir. If there is a locator, there would be a ", at *2-3" after the archive#. That's the only situation I'm aware of when you would use "at" in a full case citation.
  • That's covered. This should be out tomorrow.
